2. Eligibility

By using our Services, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction.
• You have the legal capacity to enter into a binding contract.
• You are not barred from using our Services under the laws of India or any other applicable jurisdiction.

3. Nature of Platform (Not a Broker)

We do not solicit, accept, or hold funds from the public for the purpose of investment or trading in live financial markets. All accounts provided to users during the evaluation and subsequent phases are virtual demo accounts holding simulated currency.

4. Virtual Trading and Simulation

All trading activity on the Believers Capital platform occurs in a simulated environment using real-time market data. Users acknowledge that:

• No real trades are executed in the live market.
• Users are strictly trading with virtual funds.
• Hypothetical or simulated performance results have certain limitations and do not represent actual trading.
• Past performance in a simulated environment is not indicative of future results in a live trading environment.

5. No Financial Advice

The content provided on our website, including educational materials, analysis, and charts, is for informational purposes only. Nothing contained herein constitutes financial, investment, tax, or legal advice. You are solely responsible for your own trading decisions and strategies.

6. Evaluation and Funded Trader Programs

Our service allows traders to pay a fee to undergo an evaluation process. Upon successfully meeting our specific trading objectives (profit targets, risk management rules, consistency), a user may qualify for a "Funded Account" status.

Clarification on Funded Accounts:

• Even as a "Funded Trader," you continue to trade on a virtual account.
• We (Believers Capital) or our partners may replicate your trades in the real market at our own discretion and risk.
• You are entitled to a performance fee (profit split) based on the simulated profits generated, subject to our Payout Policy.
• You are an independent contractor, not an employee of Believers Capital.

7. Prohibited Activities

To maintain the integrity of our platform, the following activities are strictly prohibited and may result in immediate account termination and forfeiture of fees:

• Gambling Strategies: High-risk betting, all-in trades, or strategies that rely on luck rather than analysis.
• Exploiting Errors: Taking advantage of platform latency, price glitches, or technical bugs.
• Account Sharing: allowing third parties to trade on your account or trading on behalf of others.
• Hedging: Using multiple accounts to hedge positions against each other.
• Automated Bots: Use of unauthorized high-frequency trading bots or AI execution without prior approval.

8. Refund Policy

Due to the nature of digital goods and services, all sales are final. Refunds are only issued if the evaluation service has not been initiated (i.e., no trades have been placed) and the request is made within 14 days of purchase. Once a trade is placed, the service is considered consumed, and no refund will be granted.

9. Intellectual Property

All content, trademarks, logos, software, and educational materials on this platform are the exclusive property of Believers Capital. You are granted a limited, non-exclusive license to use the platform for personal use. You may not copy, distribute, or reverse-engineer any part of our platform.

10. Limitation of Liability

To the fullest extent permitted by law, Believers Capital shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

• Your use or inability to use the service.
• Technical failures, server downtime, or data inaccuracies.
• Trading losses (as no real money is involved on the user's side).
• Any unauthorized access to your account.

11. Indemnification

You agree to indemnify and hold harmless Believers Capital, its directors, employees, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the platform.

12. Modification of Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on this page. Your continued use of the platform after changes constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
